In order to better provide you with our numerous services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. You provide certain Personally Identifiable Information to us when you:

 

(a)        register for our services and register your e-mail address with us;

 

(b)       enter sweepstakes or contests sponsored by us or one of our partners;

 

(c)        sign up for special offers from selected third parties;

 

(d)       send e-mail messages, submit forms, or transmit other information by telephone or letter; or

 

(e)        submit your credit card or other payment information when ordering and purchasing products and services on our site.

 

We may also collect information from you at other points on our site that state that such information is being collected.

 

In addition, we may also collect, or our third-party ad server and/or content server may collect, certain Non-Personally Identifiable Information. This information is ultimately stored in the form of store categories, and, in some cases, specific URLs. (or agents working on behalf of KAM Behavioral Academy, Inc., and under confidentiality agreements) will send you these direct mailings and only if you indicated that you do not object to these offers. This California Privacy Policy Addendum supplements the information contained in the General Privacy Policy of KAM Behavioral Academy, Inc., and its subsidiaries (collectively, “we,” “us,” or “our”) and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). California Residents.

 

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits you, if you are a California residents, to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.   1. Exercising Access, Data Portability, and Deletion Rights

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

 

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We endeavor to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

  1. Non-Discrimination

 

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

 

  • Deny you goods or services.

 

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

 

  • Provide you a different level or quality of goods or services.

This General Data Protection Regulation (“GDPR”) Privacy Policy Addendum supplements the information contained in the General Privacy Policy of KAM Behavioral Academy, Inc., and its subsidiaries (collectively, “we,” “us,” or “our”) and applies solely to visitors, users, and others who reside in or are citizens of the European Union or the United Kingdom (“consumers” or “you”).

 

  1. Data protection principles

 

We are committed to processing data in accordance with our responsibilities under the GDPR.

Article 5 of the GDPR requires that personal data shall be:

 

  1. processed lawfully, fairly and in a transparent manner in relation to individuals;

 

  1. collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;

 

  1. adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

 

  1. accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;

 

  1. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organizational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and

 

  1. processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

 

  1. General provisions

 

  1. This policy applies to all personal data processed by us.

 

  1. Our Privacy Compliance Officer shall take responsibility for our ongoing compliance with this policy.

 

  1. This policy shall be reviewed at least annually.

 

  1. Lawful purposes

 

  1. All data processed by the KAM Behavioral Academy, Inc., must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task, or legitimate interests.

 

  1. Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.

 

  1. Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent will be clearly available and systems will be in place to ensure such revocation is reflected accurately in our systems.

 

  1. Data minimization

 

  1. We shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

 

  1. Accuracy

 

  1. We shall take reasonable steps to ensure personal data is accurate.

 

  1. Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.

 

  1. Archiving / removal

 

  1. To ensure that personal data is kept for no longer than necessary, we shall put in place an archiving policy for each area in which personal data is processed and review this process annually.

 

  1. The archiving policy shall consider what data should/must be retained, for how long, and why.

 

  1. Security

 

  1. We shall ensure that personal data is stored securely using modern software that is kept up to date.

 

  1. Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorized sharing of information.

 

  1. When personal data is deleted, this should be done safely such that the data is irrecoverable.

 

  1. Appropriate back-up and disaster recovery solutions shall be in place.

 

  1. Breach

 

In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data, we shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO (more information on the ICO website).
